1. Agreement to Terms

InsuredTruck.com ("the Website") is operated by Analytics Blueprint LLC ("we," "us," or "our"). By accessing or using the Website, or by submitting information through any form on the Website, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Website or submit any information.

2. What We Are (and Are Not)

InsuredTruck.com is a lead generation and matching service. We connect commercial trucking operators with licensed insurance professionals who can provide insurance quotes and policy options.

InsuredTruck.com is NOT:

  • An insurance company, carrier, or underwriter
  • A licensed insurance agency, broker, or producer in any state
  • Regulated as an insurer by the Texas Department of Insurance or any other state insurance regulator
  • A provider of insurance advice, quotes, or policies

We do not sell insurance. We do not make coverage decisions. We do not guarantee any insurance outcome. All insurance products are offered and sold exclusively by independent licensed insurance professionals who are solely responsible for their own regulatory compliance.

3. How Our Service Works

When you submit a quote request form on our Website:

  1. You provide information about your trucking operation and insurance needs.
  2. We sell or transfer your information (your "lead") to licensed insurance agents, insurance companies, and lead aggregator platforms who may be able to help you.
  3. Those insurance professionals contact you with quotes and coverage options.
  4. You evaluate the options and choose whether to purchase coverage. There is no obligation to buy.

Your lead may be sold to multiple buyers. You may be contacted by several insurance agents and companies. Each company that receives your lead may use it according to their own terms and privacy policies.

Our service is free to you. We generate revenue by selling leads to insurance professionals and aggregator platforms.

4. TCPA Consent and Communications

By submitting a quote request form on our Website, you provide your express written consent under the Telephone Consumer Protection Act (TCPA) and applicable state laws to be contacted by InsuredTruck.com and its insurance partners, including:

  • Phone calls to the number you provide, including calls made using automatic telephone dialing systems (ATDS) and prerecorded or artificial voice messages
  • Text messages (SMS/MMS) to the number you provide, which may be sent using automated technology
  • Emails to the address you provide, including marketing and follow-up communications

Consent is NOT a condition of purchasing insurance. You may refuse to provide consent and still seek insurance through other channels.

Expected contact frequency: You may receive 1 to 5 phone calls or text messages within 24 hours of submitting your form, and additional contacts within 7 days. Contact may continue for up to 30 days unless you revoke consent.

Message and data rates may apply depending on your wireless carrier and plan.

To revoke your consent at any time:

  • Reply STOP to any text message
  • Tell any calling agent to place you on the do-not-call list
  • Click the unsubscribe link in any email
  • Email privacy@insuredtruck.com with the subject "Revoke Consent"

We will process revocation requests within 10 business days.

5. Information Sharing and Lead Sales

By submitting your information through our Website, you authorize InsuredTruck.com to:

  • Share your information with licensed insurance agents, brokers, and insurance companies
  • Sell or transfer your lead to insurance aggregator platforms and lead buyers (including, but not limited to, platforms such as SmartFinancial, Tivly, and similar insurance marketplaces)
  • Allow those entities to contact you about insurance products
  • Allow those entities to further distribute or resell your information to additional insurance professionals within their networks

You understand that:

  • Your information may be shared with multiple insurance professionals simultaneously
  • Your lead may be sold more than once
  • You may receive contact from many different agents and companies
  • Each entity that receives your information operates under its own privacy policy and terms

InsuredTruck.com is not responsible for the actions, communications, or practices of third parties after your lead has been transferred. For more details, see our Privacy Policy.

6. Do Not Call Compliance

If you are registered on the National Do Not Call Registry (DNC), your express written consent provided through our form authorizes contact that would otherwise be restricted by the DNC list.

To be placed on our internal do-not-call list:

We will add you to our internal DNC list within 10 business days and stop selling your lead to new buyers. We cannot recall leads already distributed to third parties, but we will notify our lead buyers of your request.

7. Your Representations

By submitting information through our Website, you represent and warrant that:

  • All information you provide is accurate and truthful
  • You are the person identified in the form submission
  • You are at least 18 years of age
  • You are authorized to provide the phone number and email address submitted
  • You have read and understood these Terms and our Privacy Policy

8. Disclaimer of Warranties

InsuredTruck.com provides this service "AS IS" and "AS AVAILABLE" without warranties of any kind, whether express or implied. We do not warrant that:

  • Insurance quotes will be obtained or that rates will be favorable
  • Insurance professionals will contact you within any specific timeframe
  • Information on our Website is complete, accurate, or current
  • The Website will be uninterrupted, error-free, or secure
  • Any insurance coverage will be approved or issued

The information on this Website is for general educational purposes and should not be considered insurance advice. Always consult with a licensed insurance professional for advice specific to your situation.

9. Limitation of Liability

To the maximum extent permitted by applicable law, InsuredTruck.com's total liability to you for all claims arising from or related to your use of the Website or our services shall not exceed one hundred dollars ($100) or the amount you paid to use this service, whichever is less.

In no event shall InsuredTruck.com be liable for any indirect, incidental, consequential, special, or punitive damages, including but not limited to loss of profits, data, business opportunities, or goodwill, even if advised of the possibility of such damages.

Exceptions: These limitations do not apply to liability arising from gross negligence or willful misconduct by InsuredTruck.com, or to the extent that applicable law prohibits such limitations (including statutory damages under the TCPA or similar consumer protection statutes).

10. Indemnification

You agree to indemnify, defend, and hold harmless InsuredTruck.com and its owners, officers, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorney's fees) arising from:

  • Your use of the Website
  • Inaccurate or misleading information you provide
  • Your violation of these Terms
  • Your violation of any third party's rights

11. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of law principles. Any legal proceedings related to these Terms that are not subject to arbitration (see Section 12) shall be brought exclusively in the state or federal courts located in Texas.

12. Dispute Resolution

Informal Resolution First: Before initiating any formal proceedings, you agree to contact us at privacy@insuredtruck.com and attempt to resolve the dispute informally for at least 30 days.

Binding Arbitration: If informal resolution fails, any dispute arising from or relating to these Terms or your use of the Website shall be resolved by binding arbitration administered by the American Arbitration Association (AAA) under its Commercial Arbitration Rules. The arbitration shall be conducted in Texas.

Exceptions to Arbitration:

  • Claims that may be brought in small claims court (under $10,000)
  • Either party may seek injunctive or equitable relief in court
  • Claims under the TCPA, state consumer protection statutes, or other laws that provide for a right to bring claims in court may be pursued in either court or arbitration at the claimant's election

Class Action Waiver: You agree that any dispute resolution proceedings will be conducted on an individual basis, not as a class action, collective action, or representative action. You waive any right to participate in a class action lawsuit or class-wide arbitration.

13. Modifications

We reserve the right to modify these Terms at any time. When we make changes, we will update the "Last updated" date at the top of this page. Your continued use of the Website after changes are posted constitutes acceptance of the modified Terms. For material changes that affect your TCPA consent or privacy rights, we will make reasonable efforts to provide notice.

14. Severability

If any provision of these Terms is found to be unenforceable or invalid by a court of competent jurisdiction, that provision will be modified to the minimum extent necessary to make it enforceable, and the remaining provisions will continue in full force and effect.
